CHATTANOOGA, TN, June 25, 2024 – It is with profound sadness that we mourn the passing of Doug Carmichael, CEO and co-founder of Transport Enterprise Leasing (TEL). He passed Monday, June 24, 2024, surrounded by family in Chattanooga after a brief illness.

“Doug was an extraordinarily compassionate business leader who cared deeply about the men and women in our company, and about the success of each and every one of our customers,” said TEL President Jud Alexander, Doug’s co-founder in the business and close friend. The two launched TEL in 2004, building it into a leading national provider of commercial truck and trailer leasing, sales and remarketing.

“Doug was an amazing business leader, and even more importantly he was a man of faith beloved by his family, friends, co-workers, customers and community. Our hearts and prayers are with his wife, their children, grandchildren and entire family,” Alexander said.

A veteran of the U.S. Army, Doug Carmichael began his career in trucking in the 1980s as an independent owner-operator. He grew his business into a fleet of 50 trucks before entering the truck and trailer sales arena. He and Jud Alexander worked together at Covenant Transport, helping the company sell and dispose of used equipment, before starting TEL 20 years ago.

Ever since, Doug Carmichael’s vision was to build Transport Enterprise Leasing into a brand known for outstanding quality and customer service. The company’s first 10 years were critical for evaluating its business model, establishing credibility, and finding the right fit in the industry. TENNESSEE HIGHWAY SAFETY OFFICE JOINS NASCAR STAR ROSS CHASTAIN FOR TRAFFIC SAFETY EVENT

 

NASHVILLE, Tenn. – On Friday, June 28, the Tennessee Highway Safety Office (THSO) will join NASCAR driver and defending Nashville race winner Ross Chastain for a traffic safety event, reminding attendees to “Use Your Melon” and never drink and drive. This event is exclusive for students at Lincoln Tech’s NADC campus in Nashville. This event is not open to the public, but media is invited to attend and help spread awareness for traffic safety. According to Tennessee’s Integrated Traffic Analysis Network (TITAN), there were 6,159 traffic crashes statewide involving a drunk driver in 2023. Nearly 45 percent of drunk drivers were ages 20 – 34.

 

During the event, Ross Chastain will sign autographs, offer photos with his show car, and discuss the dangers of drunk driving. Accompanying Ross Chastain will be the 2024 Illiana Watermelon Queen Maya Snider from Terre Haute, IN, who will hand out free watermelon slices to participants. The THSO will showcase its seat belt convincer, a device allowing attendees to feel the impact of wearing a seat belt during a crash. Traffic safety partners will offer activities onsite to teach driver safety and provide educational materials for students. Participating agencies include Tennessee Highway Patrol, Mothers Against Drunk Driving, Students Against Destructive Decisions, Tennessee Trucking Foundation, Tristar Skyline Medical Center, Vanderbilt University Medical Center, AAA – The Auto Club Group, Blake McMeans Foundation, and more.

On April 25, 2024, the Tennessee General Assembly passed HB 1893/SB 2103 repealing the property base component of the Tennessee franchise tax. Historically, the franchise tax base was calculated as the greater of Net Worth (assets minus liabilities) or the net book value of real and tangible property. The passage of this law eliminates the property base calculation and allows for taxpayers that have paid Franchise taxes based on the property tax base for the preceding three years to file a refund claim for the difference between the property tax base assessment and the calculated net worth base.

Affected taxpayers will have from May 15, 2024 to November 30, 2024 to file claims for refunds for returns filed on or after January 1, 2021, for fiscal tax years ending March 31, 2020, or later. Taxpayers claiming the refund will waive the right to file suit regarding the constitutionality of the prior franchise tax law.

Finally, to increase transparency surrounding refund claims, the Tennessee Department of Revenue will publish on its website from May 31, 2025 through June 30, 2025 the name of each claimant and a range of the applicable refund issued. The disclosures will fall into three ranges 1) $750 or less 2) $751-$10,000 and 3) $10,001 and greater.

TENNESSEE’S SEAT BELT USAGE RATE REACHES HIGHEST ON RECORD

Tennessee Highway Safety Office Reports 92 Percent Seat Belt Usage Rate

 

TENNESSEE – Today, the Tennessee Highway Safety Office (THSO) announced results from its annual roadside observational survey to determine the state’s average seat belt usage rate. This survey returned a statewide usage rate of 92 percent. The 2023 usage rate represents an increase of approximately 1.5 percent compared to Tennessee’s 2022 survey result of 90.5 percent. The 2023 survey result is Tennessee’s highest annual seat belt usage rate to date.

 

“Seat belts save lives,” said THSO Director Buddy Lewis. “The purpose of this annual survey is to help the THSO and traffic safety partners identify the demographics and areas of the state most in need of support to increase seat belt usage. Our goal is to reach as many drivers as possible to reduce traffic injuries and fatalities across Tennessee.”

Every year, the THSO works to improve the state’s seat belt usage rate by increasing occupant protection education through programs like Ollie Otter, Reduce TN Crashes, and other THSO grant-funded initiatives. The THSO also promotes the National Highway Traffic Safety Administration’s “Click It or Ticket” seat-belt enforcement campaign to remind citizens to buckle up.

Highlights from Tennessee’s 2023 seat belt survey are as follows.

  • Research data was collected at 190 pre-identified roadway locations across Tennessee.
  • Researchers observed almost 27,000 vehicle occupants.
  • Vehicles observed included passenger cars, pickup trucks, vans, and SUVs.
  • The highest usage rate was observed among occupants in sport utility vehicles (96.1 percent).
  • The lowest usage rate was observed among occupants in pickup trucks (82.4 percent).
  • Female occupants were observed to have a higher usage rate (97.6 percent) than males (88.4 percent).
  • Front-seat passengers were observed to have a higher usage rate (93 percent) than drivers (91.8 percent).
  • County-level usage rates exceeded 90 percent in 11 of 16 counties included in the survey’s sample.
  • Davidson and Knox Counties tied for the highest usage rate (95.1 percent) among sampled counties.

 

This data was collected through an annual roadside observational survey conducted by the University of Tennessee’s Center for Transportation Research during the spring of 2023 in accordance with the National Highway Traffic Safety Administration’s Uniform Criteria for State Observational Surveys of Seat Belt Use.

On May 3-4th, 2024, truckers from all across Tennessee gathered at the FedEx Freight Nashville facility in Antioch, TN for the much-anticipated annual Truck Driving Championships (TDC). Despite the rain, the event unfolded with an electrifying atmosphere as drivers showcased their expertise behind the wheel. The Tennessee General Assembly adjourned the 2024 legislative session sine die on April 25, 2024. Highlights of the session include:

  1. Passage of a $52.8 billion dollar budget that adds to public school funding, rainy-day savings fund, and rural health initiatives.
  1. Revision of Tennessee’s 90-year-old franchise tax laws and enacting a refund for taxes paid by qualifying businesses.  This was adopted with a 3 1/2 year look-back on a refund and disclosures of companies receiving a refund to be made public for 30 days between May 31 and June 30, 2025.  That list will break the companies down into four different categories: companies receiving refunds from $0-$750, companies receiving refunds from $750-$10,000, companies receiving greater than $10,000, and companies whose applications are pending. Companies must also agree to waive all further claims with the state. Any company not applying for a refund that elects to sue the state instead will not be entitled to attorney’s fees.
  1. Lee Administration’s statewide Education Scholarship Plan is dead for the year. After much debate for the entire session, the Administration’s plans to establish 20,000 government-funded educational scholarships across the state, giving parents the opportunity to move children from public schools to private schools, failed to gain enough support for legislative passage and was tabled for future consideration.

On behalf of TTA we tracked more than 3,000 bills and more than 100 bills for active participation on behalf of the industry. One bill of particular interest was an effort to require that all trucks weighing 16,000 lbs. or more have license plates on the front and back. This legislation failed to move out of committee.

A major piece of legislation that was a priority for TTA this year was the passage of legislation to address predatory booting and to modernize the existing towing statutes. The Tennessee legislature passed a major overhaul of towing and booting laws, SB1692/HB1731, which was sponsored by Senate Majority Leader Jack Johnson (R-Franklin) and Representative Jake McCalmon (R-Franklin) that generally prohibits booting or the use of immobilization devices on vehicles in Tennessee, absent a few exceptions for individuals licensed through a local government. The bill also proposes new regulations for towing and parking to further protect drivers and vehicle owners.

The bill prohibits unlicensed individuals from booting vehicles in Tennessee and limits booting to commercial lots only. Further, in order to boot a vehicle in a commercial parking lot, a licensed parking attendant must be present, easily identifiable as an employee of the commercial lot, and available to remove the boot within 45 minutes from point of contact. The bill caps the fee to remove a boot at $75. Notice provisions have also been added to ensure drivers are aware that parking in a lot without pay could result in the vehicle being booted or towed.

Most noteworthy for the trucking and transportation industry, this legislation makes it illegal to boot or use any device to immobilize trucks and trailers anywhere in Tennessee.

The legislation also ensures that vehicle owners are properly notified if their vehicle is towed, sold or demolished by a towing company and directs the Department of Revenue to create a motor vehicle portal. The portal may be accessible by law enforcement, towing companies, vehicle owners, and lien holders. The portal will be used for all public notifications of the sale of unclaimed vehicles.

Additionally, the bill provides that if the towing process has begun, but the vehicle has not yet left the parking area, the towing company is required to release the vehicle to the owner for a fee of no more than $100. Lastly, towing and storage fees will be tied to the local Highway Patrol schedule in each specific district, in an effort to combat unnecessary and excessive fees.

The legislature made a one-time $300,000 appropriation to fund the creation of the motor vehicle portal. The law will go into effect July 1, 2024, except for the implementation of the vehicle portal which will go into effect July 1, 2025, at the request of the Dept. of Revenue.

Finally, the conclusion of this two-year term of the General Assembly also means the departure of several long-time influential incumbents that have always been supportive of the industry. Those retiring from the legislature  include Senator Art Swann (R-Maryville), Deputy House Speaker Curtis Johnson (R-Clarksville), Committee Chairman Dale Carr (R‑Sevierville), Representative John Holsclaw (R-Elizabethton), House Committee Chairman Sam Whitson (R-Franklin), and Representative Darren Jernigan (D-Nashville).
