Safety Spotlight: CMV Cargo Safety – Inspection, Securement & Regulatory Compliance

 

The inspection of cargo, cargo securement devices, and systems is a must. Federal regulations state that a driver may not operate a CMV nor a carrier require or permit a driver to operate a CMV unless the cargo is properly distributed and adequately secured as outlined in 393.100 through 136. The CMV tailgate, doors, tarpaulins, spare tire, and other equipment used must also be secured.

 

Cargo or other objects must not block the view ahead or to the left or right sides, interfere with the free movement of arms or legs, prevent access to things required for emergencies, or prevent anyone from exiting the vehicle. The driver must ensure that the regulations in 392.9 have been complied with before driving the CMV. He or she should reexamine the cargo and its load securement during the course of a run and make any necessary adjustments, including adding more devices to ensure the cargo cannot shift on or within, or fall from the vehicle and trailer. As with any Federal regulation, there is an exception: the rules in 392.9 do not apply to a driver of a sealed load who has been ordered not to open it to inspect the cargo or the freight has been loaded in such a manner that makes the inspection impracticable.

 

Is the cargo compartment considered sealed according to 392.9 (b) (4) when it is secured with a padlock, and the driver has a key? NO – the driver has ready access to the cargo compartment and would be required to perform the examinations of the cargo and load-securing devices.

 

Is there a requirement that a driver must personally load, block, brace, and tie down the cargo before driving? NO- but the driver is required to be familiar with methods and procedures for securing cargo and may have to adjust the cargo or securing devices according to 392.9(b).
